This paper concerns the issue of an undertaking deciding unilaterally to change parts of its terms and conditions used with consumers after it discovers that the terms include abusive clauses. According to a widely-held view, such an unilateral action constitutes an infringement of collective consumer rights. The author presents a different legal perspective on this subject.
