CARS has prepared an expert opinion on the restriction of operation of pharmacies. The subject of the expertise is the legal analysis of the constitutionality of Article 99 para. 3a of the Act of 6 September 2011 Pharmaceutical Law, including the possibility of direct application of the Polish Constitution by an administrative court. The scope of the analysis is determined by constitutional law, including the jurisprudence of the Constitutional Tribunal, in particular judgments in which the control model was Article 2, Article 8, Article 20, Article 22 or Article 31(3) of the Constitution.
