The 9th meeting of the CARS Open PhD Open Seminar was dedicated to the problem of the continuation of a block exemption for horizontal co-operation agreements between insurers. In March 2010, the European Commission issued Regulation 267/2010 on the application of Article 101(3) of the Treaty on the Functioning of the European Union to certain categories of agreements, decisions and concerted practices in the insurance sector.

The new EU regulation is likely to influence Polish legislation considering that the current Polish block exemption expires on 31 March 2011. The potential scope of a new Polish regulation, its content and the impact of the European regulation upon national legislation were broadly discussed during the seminar. In the speaker’ view (joined by the representative of the Polish Insurance Chamber) the Polish block exemption should be even broader (in reference to the number of categories of exempted agreements) than the EU regulation.
