The 10th meeting of the CARS Open PhD Seminar was concentrated on the question if procedural fairness is respected to a satisfactory degree in the proceedings before the Polish and EU competition authority. The results of the individual research project completed by Maciej Bernatt – PhD candidate at Jean Monnet Chair on European Economic Law, were the basis for the introductory speech. Maciej Bernatt underlined that the concept of procedural fairness plays an important role in the enforcement of competition law, which must not only be effective but also fair. In his opinion, legal institutions should guarantee a proper level of protection of the values of procedural fairness.
Maciej Bernatt focused on the guarantees of the values of procedural fairness – right to be heard, right to equal participation, right of defence, right to protection of business secret and other confidential information, right to court review and judicial control of the proceedings before the competition authority. He showed where the changes are needed and proposed new interpretation of the current legal norms as well as the introduction of the new ones.
