The seminar "The Rule of Law and the Internal Market of the EU/EEA" was held at the Faculty of Management of the University of Warsaw on 19 May 2023.

It attempted to systematically discuss the effects that the rule of law crisis in EU Member States such as Poland and Hungary has (or may have in the future) on the Internal Market of the Union and the European Economic Area. Building on the current examples of this relationship (e.g. the Court's ruling in the T-791/18 Sped-Pro case), the seminar will focus on a few spheres in which the erosion of the rule of law is negatively translating into the functioning of the legal foundations of the Internal Market: the free movement of goods, persons, services and capital, which are the backbone of the Internal Market, as well as competition law, the independence of regulatory institutions and private law. The seminar is co-organized by the Center for Antitrust and Regulatory Studies at the Faculty of Management of the University of Warsaw, the Institute of Legal Sciences of the Polish Academy of Sciences and the University of Oslo – In cooperation with ASCOLA Central Europe Chapter.

 

Discussion at the seminar will revolve around four papers:

Prof. Maciej Taborowski (Institute of Legal Sciences of the Polish Academy of Sciences): Relationship between the EU Internal Market and the Value of the Rule of Law

Dr. Mateusz Grochowski (Max Planck Institute, Hamburg): Private Law Dimension (including consumer law)

Prof. Maciej Bernatt (University of Warsaw): Public Law Dimension: EU Competition Law

Prof. Christophe Hillion (University of Oslo): External Dimension: the Rule of Law & the EEA

 Comments on the papers will be delivered by: Prof. Kati Cseres (University of Amsterdam), Prof. Sybe de Vries (Utrecht University), Prof. Dawid Miąsik (Institute of Legal Sciences, Polish Academy of Sciences), Prof. Małgorzata Kozak (Utrecht University).
